Flashcards

Terms of Use

Effective October 1, 2026. Contact: hello@tapston.com.

1. Agreement and app-store terms

These Terms of Use are an agreement between you and the provider of Flashcards identified on the app-store listing. They govern the Flashcards service in addition to any mandatory app-store terms. By creating an account, purchasing a subscription, or using Flashcards, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Flashcards. For an Apple-distributed copy, Apple's Standard Licensed Application End User License Agreement applies to the app license unless the App Store listing expressly provides a custom EULA. These Terms are additional service terms and do not reduce rights granted by that EULA or applicable law.

2. Limited license and ownership

Subject to these Terms and the applicable app-store rules, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use Flashcards on devices you own or control for lawful personal use. You may not copy, sell, sublicense, rent, distribute, modify, reverse engineer, bypass security or usage controls, or create derivative works from Flashcards except to the extent a restriction is prohibited by law. Flashcards, including its software, design, branding, documentation, and non-user content, is owned by us or our licensors and protected by intellectual-property laws. No rights are granted except those expressly stated.

3. The service and your account

Flashcards lets you create and organize language-learning cards, study them, enter text manually or with speech recognition, and request optional AI-generated memory aids. Some features require an account and internet access. You are responsible for keeping your sign-in credentials secure, restricting access to your device, and activity under your account. Promptly notify us of suspected unauthorized use. Information you provide must be accurate and lawful. You may not transfer, sell, or share an account in a way that compromises security or circumvents service limits.

4. Free allowance and subscriptions

You may store up to 10 words across all sets without a subscription. Monthly and annual auto-renewing subscriptions unlock storage above that limit. There is no free trial. The App Store shows the price and currency before confirmation and charges your Apple Account when you confirm the purchase. A subscription renews automatically for the same period unless you cancel it in your Apple Account subscription settings before renewal. Deleting the app or your Flashcards account does not cancel an Apple subscription. You can restore eligible purchases in the app. Apple handles billing and refunds under its rules and applicable law. We may change future subscription prices or features only as allowed by the store rules and applicable notice requirements. Mandatory consumer rights are not limited by these Terms.

5. Your content and feedback

You retain ownership of the words, translations, set names, feedback, and other content you add. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, cache, and back up that content solely as reasonably necessary to operate, secure, support, and improve Flashcards, provide features you request, and comply with law. This license ends when the content is deleted, except for limited backup, security, legal, and account-unlinked shared-cache retention described in the Privacy Policy. You represent that you have the rights needed to submit the content and that it does not violate law or another person's rights. If you voluntarily send product ideas or feedback, we may use them without restriction or compensation, without identifying you publicly.

6. Speech and AI-generated content

Speech recognition is performed on the device when the selected language and platform support it. An AI memory aid is generated only after you request it, the selected word, translation, and language information are then sent through our server to OpenAI. Do not include personal, confidential, regulated, or proprietary information in an AI request. Recognition, translations, examples, and AI output may be incomplete, outdated, offensive, or wrong. Review them before relying on or saving them. Flashcards and its AI output are educational tools, not professional, medical, legal, financial, or safety advice, and do not guarantee any learning result.

7. Acceptable use

Do not misuse the service, interfere with its operation or security, probe or access systems or data without authorization, introduce malware, scrape or automate access without written permission, evade quotas, subscription checks, or technical limits, impersonate another person, submit unlawful or infringing content, or use Flashcards to violate law or another person's rights. We may investigate suspected misuse and preserve or disclose information when reasonably necessary to protect users or the service, enforce these Terms, or comply with lawful process.

8. Third-party services

Flashcards uses services provided by Apple, Google, Firebase, OpenAI, Meta (Facebook), network operators, and device-platform providers. Meta SDKs in supported mobile versions provide app analytics and advertising conversion measurement. The Privacy Policy describes the information involved, automatic collection settings, and how to disable Meta measurement separately from Firebase analytics. You do not need a Facebook or Instagram account to use Flashcards. Disabling Meta measurement does not change access to study features or an existing subscription. If you choose to use a third-party service directly, that service may be governed by its own terms and privacy policy. We do not control third-party services, outages, decisions, content, or changes, except to the extent applicable law makes us responsible. Apple has no obligation to provide maintenance or support for Flashcards. Support requests should be directed to us.

9. Changes, availability, and your backups

We may add, change, suspend, limit, or discontinue features for security, legal, technical, or product reasons. We will provide notice when required by law. Internet, store, device, and third-party failures may interrupt service or synchronization. Keep any independent copy you need of important material and verify that changes have synchronized before deleting the app, clearing storage, changing devices, or signing out. We are not a permanent archival or backup service.

10. Suspension, termination, and account deletion

You may stop using Flashcards at any time and may request account deletion from the profile screen after reauthentication and confirmation. Account deletion removes data as described in the Privacy Policy but does not cancel an App Store subscription. We may restrict, suspend, or terminate access for a material or repeated breach, fraud, security risk, unlawful conduct, nonpayment, legal requirement, or discontinuation of the service. Where reasonably practicable and legally required, we will provide notice and an opportunity to export or retrieve content. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, indemnity, and dispute terms, remain effective.

11. Disclaimers

To the maximum extent permitted by law, Flashcards and all output are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and uninterrupted or error-free operation. We do not warrant that content will be preserved or synchronized, that recognition or AI output will be accurate, or that the service will meet your requirements. Nothing in these Terms excludes or limits a warranty, remedy, or liability that cannot lawfully be excluded or limited.

12. Limitation of liability

To the maximum extent permitted by law, neither we nor our licensors or service providers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, content, opportunities, or business interruption arising from or related to Flashcards, even if advised that such loss was possible. To the maximum extent permitted by law, our total aggregate liability for all claims relating to Flashcards will not exceed the greater of the amount you paid for Flashcards subscriptions during the 12 months before the event giving rise to the claim or USD 50. These limits apply regardless of the legal theory and do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or other liability that applicable law does not permit us to limit.

13. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold us and our licensors and service providers harmless from third-party claims, damages, and reasonable costs arising from your unlawful content, your intentional misuse of Flashcards, or your material breach of these Terms. This section does not require a consumer to indemnify us for our own negligence, breach, or conduct for which indemnification cannot lawfully be required. We may control the defense of a covered claim and you will reasonably cooperate.

14. Apple-specific acknowledgements

For Apple-distributed copies, you acknowledge that these Terms are between you and us, not Apple. We, not Apple, are responsible for Flashcards and for addressing support, product, privacy, regulatory, and intellectual-property claims relating to it. If Flashcards fails to conform to an applicable warranty, you may notify Apple and Apple may refund the applicable purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of the terms applicable to an Apple-distributed copy and may enforce those terms. Your use must comply with Apple Media Services terms and applicable third-party agreements.

15. Children, export, and legal compliance

Flashcards is not directed to children under 13. If local law requires a higher age for independent consent, a parent or legal guardian must provide any required authorization and supervise use. You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism and are not listed on a United States government prohibited or restricted-party list. You must comply with applicable export, sanctions, consumer, privacy, and other laws.

16. Disputes and general terms

Before filing a claim, please email hello@tapston.com with a description of the issue and requested resolution and allow 30 days for an informal resolution, unless urgent relief or applicable law permits otherwise. Governing law and forum are those determined under applicable law, and consumers retain mandatory protections of their country of residence. Neither party is liable for delay caused by events beyond reasonable control. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without consent. We may assign them with the service or as part of a reorganization where lawful. These Terms, the Privacy Policy, applicable store terms, and purchase terms are the entire agreement concerning Flashcards. We may update these Terms for legal, security, or service changes, update the effective date, and provide additional notice when required. Questions, complaints, and claims may be sent to hello@tapston.com.
